The Special Leave Petition, challenging the conferment of cabinet status on three Goan politicians, is likely to come for hearing by the Supreme Court tomorrow.
Social activist and advocate Aires Rodrigues had filed the SLP challenging the order of the High Court of Bombay at Goa that did not set aside the government appointments.
He sought grant of ex-parte ad interim stay of the government orders pending disposal of the case by the apex court.
Economic Development Corporation chairman and ruling Congress MLA Agnelo Fernandes, deputy chairman of the State Planning Board and State NCP chief Dr Wilfred De Souza and Commissioner of NRI affairs and former union minister Eduardo Faleiro had been appointed in respective positions with Cabinet status by Digambar Kamat government.
The petitioner avers that conferment of Cabinet status to the politicians was " a fraud on the constitution of India and in violation of the 91st Amendment which was meant to restrict the Cabinet size and prevent jumbo size Cabinet that entail huge financial burden on the state exchequer".
He contends that the appointments defeat the sanctity of Cabinet system of government which is the corner stone of democratic polity and the basic structure of the constitution.
