Cop-on-duty not licensed to kill through reckless driving: SC

New Delhi, Mar 18 (PTI) A policeman causing the death of another person through reckless driving cannot claim immunity from prosecution on the ground that the accident occurred while he was discharging official duties, the Supreme Court has said. "We find, however, that jumping a road divider and running into incoming traffic was the factor which had caused the accident and was clearly not a matter within the colour of duty," a bench of Justices S B Sinha and H S Bedi observed in a case involving a Delhi policeman. The bench passed the ruling while dismissing the appeal filed by head constable Paul George who was convicted under IPC Sections 304 A (causing death by rash and negligent driving) 279 (rash driving at a public place).
