Ws of notpressed suit value

Hi sir we filed suit against vendor for perminant  inunction then he replied in ws that he done fraud and plot  location is some whereelse so I not pressed old suit  and filed new suit for title  declaration recovery of possession.

 

can I use written statement submitted by respondent of  old suit in criminal case in new civil suit.will it hav value

any dgement of same

Facts posted are not clear, prima facie hypothetical and academic or time pass but not a real problem of the author, please correct me if my presumption is otherwise.

You cannot include his written statement in your case.

However if you have a certified copy of the same then you can get it marked as exhibits during cross examination of the defendant.

You have already filed the suit and it is going on.

Therefore you may not be permitted to include new subject to the plaint unless you seek permission of court to amend your plaint to include the new topic.

The purported documents may be rejected by court for having not pleaded about it in the original plaint.
