Writ

my friend has purchased one house through sale deed which was registered in 2015. but  patta is not transfered to his name . now municipality without notice , coming for demolistion of house  for reason of encroachment of govt land. but he has all land records and survey number for his house. now can he file a writ in HC in his name  on basis of sale deed ( doubt is ..patta is not transfered to his name )  or previous  owner whose name is in patta.

If there is regulsarization after paying some  money for encroached land paY it to concerned authorities  and get it regularised. Or file a writ of Mandamus seeking directions to District Collector to regularise your land for a price and to Municipal Authorities not to demolish the land till the disposal of writ.

Another option is to immediately file declaratory suit with praye for Civil Injunction.
