Winding up petition

      My previous  company didnot pay 6 months salary.I  filled complain to PF office ,they have also dafaulted PF.Pf office has issued several show cause notice to the company. I have lodged complain to district labour also. till date nothing has come out.

      Should I file winding up petition or I should go for recovery suit.please guide me which option may give better results and how much each option will cost me.

Depending on the location of your company. File a application under section 33 (C) (2) of the Industrial Disputes Act.

PF: Pursue RTI route and demand that you should be allowed to be intervening party.............................The EPFO may initiate &A proceedings.

 

Wages: The conciliation Officer shall grant 3 opportunities in 30 days and then refer to labor Court.

YOu can also file complaint under:

Payment of Wages Act.
