Wife wants to get marry again, then what about the child

Hi expert,

The Case is:

Husband got divorced with his wife one year back. they have one child, 3 years old. Now his wife wants to get marry again. So please suggest,

1) can husband now file the case of custody of that child? & what is the process? & this condition what is the husband right as a father?

2) should wife take a right decision to get marriage again or she should live her life alone for her child? As her new partner is ready to accept her child & she doesn't want to give her child to his old husband.

Even visitation is not easy forget custody even if you go to court with the laws at present.

Dear Please Help! A father in india is stipped of his rights in the court system because the laws and judges heavily favour the wife.

 

Hence, your chances of getting full custody of the child are none unless you can prove:

- The mother is bad care taker

- Mother is involved in illegal activity

- Mother abuses the child and hence putting her life in danger

- Mother is ignoring the welfare of the child and not giving her proper food or education etc.

- The new husband has a criminal past or involved in illegal activity...there are many more.

 

And of the day, you verbally stating the above is not enough, you will have to prove it in court with solid evidence. Then, maybe then the court will grant you the full custody of the child. Meanwhile, apply for child visitations and keep in good contact with your child. 

 

Also, please join Child Rights organisation for husbands/fathers and seek their help and educate yourself on how you can successfully get child visitations
