Wife Murders Husband

A cunning  and cruel woman kills her husband. And to the plight of husband and his family DV can not applied. If it would have be otherwise - woman may have been killed  - apart from common section 498, DV dowry prohibition would have come in play.  But these additional section will not be applicable here. Does men have equal right to woman? Are men made to  work like and horse  and hand over earned mony to  woman?   

Most importantly   " Is woman life more valuable than man?"

Ghaziabad:  A woman along with her paramour were arrested on Friday for allegedly killing her husband, police said.



Savita and her neighbour Mahendra were arrested and they have confessed to the crime of killing Jitendra as he had caught them in compromising situation on the night of May 14, police said.



Jitendra was killed in Garhmukteshwar area of Ghaziabad on May 14 and his post mortem report had mentioned electrocution as the cause of death, police said.



Savita said that on the night of May 14 her husband came home under influence of alcohol, and caught her with Mahendra, police said.

 



Mahendra and Savita got hold of Jitendra and eliminated him using current as he was drunk and could not oppose, police said.

shocking news. men's life should be just as valuable as women's. but in a patriarchial society it won't be. (and women nicely say it's because of patriarchial society that they suffer inequalities)

If wife kills husband, she will be prosecuted under Section 302 IPC.

if husband kills wife, he will be prosecuted under Section 302 IPC. 

in addition to this, if the killing is connected with demand of dowry, then additional charges of S.304 B IPC and 498-A can be slapped with, in the case of husband.  The punishment under S. 304 B or Section 498-A are lesser than under S. 302 IPC.  But in all these circumstances, the charges have to be proved by the prosecution "BEYOND REASONABLE DOUBT".  If the husband is convicted under section 302 along with Section 304 B or 498-A, the punishment (imprisonment) runs concurrently.  so, i do not see any disadvantage to a man who killed his wife comparing to a woman who killed her husband.  Both are treated equally before law.  So far as murder is concerned woman is not given any favourable protection under Article 15(3) of the constitution.  in this forum and in several other sites a systematic villified false campaign with malafide intentions is going on against women saying that the law is giving undue favours to women, which is totally false.  the murderer, if it is a man or woman, meets the same fate.

Shameful act of the wife...now she and her lover will enjoy the hubby's assets forever!

When other hubbys read about this, the lesson they will get is to do the same to such an adultrous wife...

Any criminally organized act by any human against another iss shameful and disgraceful to their fraternity.

 

Having said this, I would like to answer to @hema.

 

When a chargesheet is filed (if you have seen one) police always tries to slap as many sections as possible so that when the prosecution fails to prove its case beyond reasonable doubts, still existence of other section might be helpful. If one ingredients of one section is not made out, may be any other lighter section might serve the purpose to push the accused behind the bars.

 

Also when a woman is prosecuted, she always takes advantage of being a woman and they seek lesser punishment on this ground alone. In absence of equal and similar protection to both genders, one gender would always misuse the laws and would never fear of doing anything wrong (which is criminally less grave like harrassing, mental torture etc)

Very logical...thats why these laws need to b amended, nobody would want to have murders in their own homes..

Oh Really .. lets take  a few cases to understand how man is treated currently vis a vis woman

 

1. In one hand Wife is not earning and Husband is earning, in second case wife is earning and husband is not earning ( if you need live examples please let me know)

 

2.  In one huband slaps wife and in second wife slaps husband.

 

3, In one hand husband is not happy with marriage and wants divorce and second Wife is not happy with marriage and wants divorce.

 

Here is legal treatment in each of these cases

 

1.  Wife uses CRPC  125 and gets maintainance. In second case also wife uses CRPC 125  and  gets order for husband to give maintenance - even if it means beg borrow or steal for husband. LAW simply says that HUSBAND HAS to MAINTAIN WIFE.

 

2. in first case woman uses DV,  498A. etc. in second man  has no such recourse he can do little  - not even speak to society - either he will not be believed ot mocked or laughed at.

 

3.  Husband can file divorce and be ready to face DV, 498, pay maintenance alimony   and long time in court. In second case  wife can file for divorce , implicates in laws family in false cases - DV, 498, in law family comes running and begging, gets maintenance from court, gets huge money in alimony and in out of court settlment.  

 

SO WHO HAS GUTS to COME FORWARD and STILL SAY THAT LAW is SAME

Except the women implicated falsely in 498 A cases all women are given special treatment... In matrimonial cases, women can be arrested / denied bail / tortured by police / dragged to courts / convicted. As soon as they get their son / brother married, they are out of the list of Indian women and infact out of the list of Indian citizens  ...

All maintenance laws should be gender neutral. And I demand this proudly inspite of being a female because I believe the responsibilities of marriage have to shared by both the spouses equally.

 

Also, there should be different treatment to maintenance cases based on duration of marriage. If its a marriage of less than an year and no children, maintenance should be abolished. If marriage duration is 2-4 (for example) years the percentage should be very less (gender neutral still). For a marriage of a long duration there should be separate rules as the partners have given each other duties and responsibilities for a long duration of time and so these cases cannot be treated at par with cases of very less duration mrg ...

I also strongly believe that laws are vastly in favor of "WIVES" and not women in general. No mothers and sisters get favors from the same laws. In fact they are treated very cruely and suffer the most inspite of being women.

When people show lot of support to these laws and law misusing wives, I really wonder why do they forget about the innocent people trapped in the false litigations by these wives. If marriage is such a personal matter of husband and wife that their families should not interfere in that at all, then the families should also be thoroughly kept away from these litigations between hubby and wife!

A murder is a heinous crime, still when a woman kills her hubby, she is treated with sympathy. People generate all sorts of reasons in her favor. The question that comes to my mind is that "if the hubby was so bad, why did she not leave him instead of killing him?"
