I'm a US Citizen and found my bride thru matrimony sites and we both agreed at the time, not to get our marriage registered at hyderabad, as she wants to visit USA soon as possible with less time of delay thru Fiance visa compared to spouse visa, which usually takes more than yr. whereas fiance is less than 6months. so we had a traditional wedding in Aug 2013, after marriage, i left back to USA to continue my work/job. in Nov 2013, she got the interview at Mumbai USA embassy, during the interview, she claimed that, she's not yet married and likes to fly to USA to accompany her fiance, which is me and get married in USA. and she got the visa. In dec 2013, I fly to hyd to accompany her back to our home.
In Jan'14 we got married here in USA as per her visa and applied for her status chance from fiance visa to greencard. from Jan'2014 to Jan' 2015 we had few arguments, here n there but overall we had a fun loving relationship from my end.
In Jan'2015 she got her temp or probationary greencard for 2yrs and she left to India for her sisters marriage, since she left, she seems differend, ignored my calls, no skype or txts.. hardly replies or answers my call, whereas me, I got more emotionally and physically attached to her during our relationship as married couple, i couldnt understand.. before marriage or between Aug'2013 to dec'2013, there were constant commnunication skype, texts, calls etc.. but when she left, she seemed different, when i asked her whats the problem, she kinda gave me vague answers, relatives are home, im busy with shopping etc.. but still she ignored etc.. my father-in-law said.. dont call her many times, we are busy etc.. and in March, she called me and said, she;s not flying back on the original flight return ticket i bought and would like to stay additional month. so me and my mom visited hyd for her sisters marraige few days earlier in March and tried to reconcile or sort things out.. there, she expressed she's not happy etc.. and would like her parents to accompany, and want me to sponsor them visa and have the same life my parents in USA have.. and i explained thats not possible in short time, as we only got married for a yr.. and with my financial situation, she's already a dependent and my sponsor form wouldnt be helpful to sponsor additional. and my parents live in texas and we live in phoenix in a one bed.. but still she was hesitant.. so me and my mom flew back to USA without attending her sister marriage.
In may 2015, she filed for divorce in hyderabad family court, but she sent the notice to my parents address in texas and my father signed the paper to recieve or registered mail. we tried to call, reconcile etc.. they wouldnt pick up phone or any.. and since may2015, the court has not recieved my dad's signature card or the reciept, so the hearding been extended thrice.. and is scheduled for 4th time in Feb.
Meanwhile, i filed for divorce in USA as per her visa on her indian passport and her greencard.
In her hyderabad divorce, she claimed false accusations that, I did not or let her pray in home or setup pooja stuff etc, i have some physco disorder, visit physc doctor every month, secretly takes medicines, i put secret cameras in bathroom and bedroom and such false accusations.. apart from this, she also filed a case in hyderabad high court about the same that, secret cameras and asked the or plead in the highcourt to not allow me to post such online.. and high court replied saying that she needs to complain where this incident happen and not in hyd and close the case.
Now, my question or help i need is, can i file defamtion case on the case she filed in high court, as any future alliance may search my name in high court website and see the prayer. and court simply said should file the complain where it happened.. but nothing related to my character?
and i'm planning to hire an attorney or advocate in hyd to content the divorce in family court that all the accusations have been false and go from there.. will the court ask her evidence to proove her accusations? cross examination or whats the process which will happen soon?
