Wife intentionally not showing kid to his dad for 7 years.. is there any advice in law to her or no?

Dear experts,

I have filed divorce petition after marriage of 5 years, and the divorce case is on going for 2 years. however from day 1 upto now she did not show my kid even though i file petition for my kid visitation. This is doing by her so intentionally that everyone knows who have humanity apart from law.

Overall its been now 7 years i did not see my kid, and he never knows i am his dad.. is there any advice under law section to her to advice her strongly to show my kid or no? again i humbly request all experts, please not say it is her choice to show kid to me or not... is it everything is girl choice in law. ?

Any of the lawyer really interested for my question, please advice.. i really fed up going to court in last 2 years not even see my kid its too pain.

1.  Depriving father access to child is not mother's choice but this is illegal deprivation of parental access. You have already filed for visitation rights, why the court have not granted yet. Your advocate should have pressed for it. In which court is your case.

2.  You may file another application for grant of weekly visitation rights as per law. If the lower court has already granted visitation rights and your wife disobeying court orders then you may file contempt of court case. She is bound to provide access to child as per law.

If you have filed an (any) application for custody of the child either in Family Court (where proceeding for divorce is stated to be pending) or any other competent court, it must (must) have been decided in your favour, it is your right which cannot be denied, check with your lawyer.

You have not mentioned whether you filed the child custody case and sought for visiation rights as an interim relief.

If you have not done so, you may file the petition at once, if already filed then you may consult your advocate on the next steps due to inordinate delay.

We can advise only legal steps but it is you to look for any other steps other than the legal process.

Really thanks for your response, I have already filed petition for child visitation rights, i mean i just want to see him monthly once. but everytime she says kid prematured so he is not well, he have health issues, kid not have school holidays all false reasons... but judge should strongly recommend to show me na sir.

I am not asking my custody, because i know i never seen him so he will never come with me if i go for custodial rights.. atleast they should show me.

its been now 2 years even after file divorce petition, they dint show so i filed visitation rights this also now 6 months.

You cannot be deprived of visitation rights. facts posted suggests that the issue is not being properly pursued before the Court.
