Whose income can be added in maintenance case

Dear Experts

Whose income can be considered at the time of deciding maintenance.

For Example :- 

1.Father's Income :- 25,000/-

2.Mothers's Income :- 25,000/-

3.Brother's Income :- 30,000/-

4. My Income (Husband) - 33000/-


Joint family income 1,13,000.00 is coourt can considered Joint family income or only my income ?

Because everthing is on sharing basis in my family, basically we are living together so my father is managing all the finanancing. I already disposed my savings. no new savings only one small car in my name.

No property etc.


Questions :

1. Whose income can be added at the time of deciding the maintenance ?

2. My Father, Mother and Brother savings can be touched by court or not ?

3. My father mother and brother Bank account lockers etc can be touched etc by court ?

4. My father Mother and Brother assest either property or yellow metal etc ?

5. Please advice for maintenance only me is reponsible or my family as well ?

all are co-respdendents in DV and Maintenance case.

At the time of deciding maintainance its husband whose income is considered..

In your case as your income is Rs.33,000/- so in the event of any maintainance or DV case the same shall be considered , until and unless you have income from other sources and the same is proved before  the court.

Only your income and expenditure will be considered by the court will deciding maintainance for your wife. The income of the other members of your family does not matter and is not considered.

What about lockers of my family members shall they purchase gold for my brothers wedding as my brother wants to marry soon. Shall my wife side can claim that this is my stridhan and all etc as generally the type of gifts are same in gold like ring chain etc but in my case my wife side has not given any chain but in list of stridhan 3 chain mentioned so tommorow if we purchase gold chain for my brothers wife she can claim that it is his stridhan ?? Please advice
