I served in Railways for 4 years 8 months 28 days and now joined in Central PSU through proper channel & NOC.
Now PSU rejected to count my service for the purpose of gratuity benefit stating that the recruitment is from open market.
I approached Railway for payment of gratuity, they rejected since the service rendered is falling short of by 3 months 2 dyas for 5 years.
I heard that 4 years 240 days continuous service makes eligible for gratuity.
If I want to file a case, which i court i have to approach, Labour court or Central Administrative Tribunal (CAT)
Pl. clarify. Also is there any chance to making a PSU a party for counting of service for the purpose of gratuity.
