Partition can only be filed by a person who is a co-owner in the property. Wife is not a co-owner. She just has right of residence. There is just one right with the wife - That is of maintenance.

Wife is not having rights. Partition, is an act by which a coparcener severs his relations with joint family and loses his status of coparcener and becomes an independent individual from the links of joint family.
