When rcr is dismissed filed by wife is beneficial for divorc


i have filed Divorce case in jan 2011. and i got RCR order in dec 2010 that was filed by her. 

and its was dismissed by court.

but still in Divorce reply she says that she is ready to join company.

but i dont want is that RCR order is  beneficial for divorce.

i m seperate from her more than 5 year and facing 498A also from last 5 year

any hope of divorce.people says that a boys cannot get divorce untill unless she wants.

but she is adament not ready to give divorce at any cost.

is it true that a boy cannot get divorce.

my 498A is on evidence stage still 7 evidence is pending only one is held.and i m from faridabad

Its not matter of wife is willing or not..There are plenty of husbands who have fought long battle and got divorce..

mr rajesh kya aap 5 year se 498a ke case me ab tak kuch nhu kar paye h.ok how many peoples name involved in 498a case

if you got RCR and co habitation does not takes place then it is one of the ground for divorce.. rfer section 13(1a)(ii).

Section 13(1A)(ii) in The Hindu Marriage Act, 1955
(ii) that there has been no restitution of conjugal rights as between the parties to the marriage for a period of 5[ one year] or upwar ds after the passing of a decree for restitution of conjugal rights in a proceeding to which they were parties.]

Means 5 year count after the order of RCR or year count after the date of appilication filed
