What are the prequisites specified by the indian law and supreme court ?

things such as needing evidence or witness before filing court case or cant directly file a court case instead of going to police first or proving your claim with irrefutable evidence for seeking ex parte order

its a general sort guidelines question whether court can directly deal with issues without the need to informing the police firswt and to file the case what are the requisites and the criteria on which a court can refuse to take case on file and for ex parte restraining order like in the maters of tenancy what does it require as proof as clearly the applicant is not under trial so as to be needed to proof evidence
