Waiting period of 24 months in insurance policy for an infant

Is it even constitutional to ask for a waiting period of 24 months to a person who himself is not 24 months. If any clause states 24 months waiting period shouldn't it be deemed 24 months or age of person whichever is lower. Kindly Guide
