Violation of approved lay out plan of building

A Community Centre was approved by town and country planning deptt. haryana for residential colony Vatika City, Sector 49, Gurugram.  Instead of Community Centre, the builder constructed a club house and charged Rs. 45,000/- per flat as membership fee.  In all the complaints against the builder, the same club house is being shown as Community Centre.  The town and country planning deptt. haryana is not taking any action against this violation of approved lay out plan.

Can it be legally challenged? Please advise

first obtain information under RTI act from the Town and Country planning Dept Haryana about the permission to construct community centre. Based on the information furnished you can take legal action.

Also without paying single rupee, a consumer case can be filed against the builder for deficiency of service in not providing a community center as stated to owners and as per permissions obtained.
