Unable to attend hearing & financial inablity to hire lawyer

Please assist me with the court's process.

We are unable to attend court date & at the same time we do not have a lawyer representing our stand.

We are staying inThane

The issue is that my bhabhi has a done a divorce case in Delhi for date 21st Oct for which we have not yet appointed a lawyer. We have a criminal case next day on 22nd Oct at Thane for 498A.

How do we excuse ourself from the hearing on 22nd Oct in Delhi..Its not possible to travel by plane for financial constraints...

Infact we have put a request to the judge who is seeing 498A ie we wish tio close the case by paying money to the girl but that will be decided only on 23rd Oct & this decision will also have an effect on the divorce & maintenance case....So what needs to be done from our side to tell the Delhi court handling divorce case for the 1st hearing..Can we send them any document from THane lawyers side....

Please assist.

Dear Querist,

The divorce case pending in Delhi coming up on dated 21st October 2010 needs to be represented on your behalf to submit that as a matter of fact you intend to close the case by offering some money to the girl once and for all which has direct bearing on pending criminal and and maintenance case. To that effect, you may appoint a lawyer for the day with such specific instruction. I guess that wont be much problemetic to seek adjournment and eventually closure of the case.

Please feel free to contact should you have any further query.

wel if u r unable hire a lawyer ,,,,, cause of financial disability,,, bring this  fact in notice to court by urself presented in court,,, there is a provision in law to provide a lawyer if defendant is poor to appoint a lawyer fr himself,,, court will appoint u a lawyer resonable or at govt. payment,, no issues,,,

secondly if u not able to attend court proceeding n every date,, an aplication unde sec 205 crpc be put to magistrate,, to dispense ur personal attendance,,,thn u only require to attend court when some important issue to agrue or evidence but mind ur presonal attendance ll only be excempt if u r reprensented by a lawyer
