Two 1bhk merged in apartment and their treatement as single


I bought flat in Nasik city before couple of years in apartment having 20 flats. There is one member in apartment, who had bought two adjecent 1 BHKs and merged them into single one. When builder handed over orally society to residents, he did not provide any documentation or did not follow any election.

Members started collecting maintenence of Rs. 500/- monthly. So 20 flat owners started contributing. But in between one of member had raised some concerns regarding merging the flats and using common passage by forming iron grills. Due to this, person who was paying maintenence for 2 flats, denied to pay it further for two flats and started giving for only 1 flat and said that his flat has only one family and single kitchen.

But as per corporation records this is 20 flat apartment, still he is not paying maintenence.
I have following questions:

1. Who is responsible to form apartment? Is it builder or members?

2. What is procedure to form apartment officially?

3. What action can be taken against such members? OR what is he saying right?


Is this society registered if its registered then check the sale deeds of each flat andbchange rule to pay each owner for every purchase deed maintenance 500 for society mentenance purpose
