IAM SHAIKH STAYING IN SOUTH MUMBAI THERE IS A PROB LEM IN MY BUILDING WHICH IS OWNED BY TRUSTS THE BUILDING CONSISTS OF 2 FLOOR AND GROUND WITH 6 SHOPS IT MORE THAN 60 YRS

OUR BUILDING IS IN A BAD SHAPE AND WE TENANTS PLANNED TO REPAIR IT AGAIN NOW GROUND AND 1ST FLOOR CONSISTS OF 6 SHOPS AND 5 ROOMS ON G+1ST FLOOR AND ON SECOND FLOOR WE HAVE OUR ROOM WHICH IS 2 ROOMS NOW AS PER TRUSTS WE HAVE BEEN PAYING RENT TO THEM SINCE MORE THAN 30 YRS FOR THE SAME FLOOR AND IT WAS ASSESSED DURING THE SAME PERIOD 

RECENTLY TRUST WERE SAYING THAT THEY ARE READY TO VOUCH ON US IN REGARDS TO THE SAME IN THE COURT OF LAW AS WELL THAT OUR SPACE IS LEGAL AND I HAD TAKEN AN INSPECTION EXTRACT FROM BMC WHICH CLEARLY SAYS THAT THE WHOLE BUILDING INCLUDING OUR ROOM IS ASSESSED.

NOW 1 WEEK LATER ONE OF OUR TENANTS HAD STARTED PLAYING GAMES AND HE I DONT KNOW HAVE CONVINCED TRUSTEES TO ALLOW HIM TO RECONSTRUCT AND MAKE 2 ADDITIONAL FLOOR WHICH WILL BE OWNED BY HIM AND FOR THAT HE HAS TO GAIN STAIRS THROUGH OUR FLOOR AND FOR WHICH HE IS CLAIMING THAT OUR STAIRCASE END PART IS NON TALLING AND FOR WHICH WE WILL LOSE THE SPACE AND WILL MAKE THE PART UTILISED FOR GAINING ACCESS TO 3RD AND 4TH FLOOR THROUGH OUR FLOOR.

NOW PLS GUIDE ME THAT 2ND FLOOR IS A TERRACE FLOOR AND THERE IS NO TERRACE IN THE BUILDING WHICH WAS ASSESSED 40 YRS BACK AND THE PLAN WHICH THE BOARD IS HAVING IS SHOWING AS G +1 BUILDING BUT IN BMC IT SHOWS G+2.

I DONT WANT HIM TO MAKE 2 ADDITIONAL FLOORS BUT TRUSTEES ARE WITH HIM.

KINDLY ADVICE WHAT STEPS SHOULD BE TAKEN FROM DISAGREEING TO MAKE HIM CONSTRUCT ADDITIONAL FLOORS.
