Transfer of property name from deceased mother to father

I am living in Kolkata. The property is in the name of my mother. After my mother deceased, we want to transfer ownership to father's name. My mother had two son (NRI) but don't want any property rights. Please advice on formalities and costs involved.

Quick Summary
This discussion addresses transferring property ownership from a deceased mother to her father in Kolkata. Key steps include obtaining a legal heirship certificate from the court and registering a family settlement deed. While the sons (NRIs) do not wish to claim rights, formal documentation is crucial to avoid future disputes. Consulting a local advocate is recommended to understand specific formalities and associated costs.

Just consult a lawyer and get the douments done. You need to make a family settlement deed and should be registerd to avoid any future litigations.Keep everything neat and clean to bear the fruits bitter  or sweet as you wish...

Hello,

You have to get the legal heirship certificate of your mother from the court. Thereafter sons can transfer the property to the father's name. You have to personally visit the advocate and find out the cost of litigation. Fees depend on the qualification and experience of an advocate.
