Hi,  please expert your advice on the folflowing:

My father expired leaving 3 sons. He has a self occupied property. He died with out  a will. Now, elder son kept house documents. He is not willing to give documents. Other sons want to sell the property and the proceeds of which will be shared by 3. In this scenario, how the property to be sold, which was in the name of the father without will? If elder son not willing to sell the property, how to tackle this issue.

Please send your exper advice>

You don't need the original documents for selling, you can get the certified copy from register office

You two can sell the  undivided share of the property. But you cannot force your elder brother to sell and your elder brother cannot stop you two selling your shares
