Transfer of plot of diseased memner

sir,

I am a member of plot society in Pune.

One member who owned a plot in our society but was residing in Dombivali,died last year.

He has not submitted any NOMINATION ,AND HE WAS UNMARRIED.

NOW  HIS BROTHER  FROM DOMBIVALI WANTS TO TRANSFER THE PLOT IN HIS NAME.

WHAT IS THE LEGAL PROCEDURE ?

HE HAS SUBMITTED AN APPLICATION AND AFFIDAVIT / iNDEMNITY FROPM HIS OTHER BROTHERS.

he has to produce a legal heir certificate  if he wants to proceed further on the issue

In this case the owner is unmarried, no nomination is made.  His brother is claiming the property by submitting Indemnity Bond and NOC from his other siblings.  You cannot entertain such requests as you do not know are the real legal heirs.  They have to obtain succession certificate from the competent first.  Then they can register a relinquishment deed in favour one of them for transferring the property.
