Transfer of petition

Dear Ld member

There are so many states which has more than one bench of HC.eg BOMBAY HC, MP HC, KARNATAKA HC etc.

If a party appeal in any one of the HC bench in above court, Can the principal judge of the said state has a power to transfer the appeal to any other bench of the HC under his jurisdiction on the request of the opposite party?

Kindly guide and inform.

 regards

SIR,

KINDLY NOTE THAT

BRIEF GUIDE LINES,

1. JURISDICTION OF THE COURT IN CIVIL SUIT  IS AS PER THE PLACE WHERE THE PROPERTY IS SITUATED .

2. IN CASE OF CRIMINAL CASES , THE JURISDICTION OF THE COURT IS AS PER PLACE OF OFFENCE.

3. IN CASE ONE WISH TO TRANSFER THE PENDING COURT CASE TO ANY OTHER COURT THEN A PROPER TRANSFER APPLICATION SHOULD BE FILED FOR TRANSFER OF THE CASE MENTIONING REASONS FOR THE SAME .AND UP ON HEARING BOTH THE PARTIES TO THE DISPUTE , THE CONCERNED COURT WILL PASS ORDER ON SAID APPLICATION .PLEASE NOTE.

4. AS PER DETAILS MENTIONED YOU MAY FILE APPLICATION FOR TRANSFER IN SAID HIGH COURT MENTIONING ALL DETAILS AND REASONS AND PRAY ACCORDINGLY.

GOOD LUCK.

N.B. SAWANT.,M.COM.LL.B., ADVOCATE HIGH COURT,
