Transfer of Brother's in my name

My brother having 42 sq. ft. Shop in squaters colony of MCGM now taken over by Mhada under road cutting has not done any nomination of the shop. My brother has now (15 days passed) expired and his wife has expired earlier 2 years prior to him, he doesn't have children. What is the procedure now to transfer the shop in my name.

Get a succession certificate from the Court concerned. After obtaining the succession certificate, the legal heirs for the succession of the property will be issued. If you have no differences between the legal heirs of your brother, then obtain a legal certificate from the Tahsildar concerned, all the legal heirs (if you have other siblings, parents) have equal right over the property. However, consult a local advocate.
