Mother and two sons. Father deceased. Did not made a will. elder son already borrowed money from mother to buy house in his name. Younger son asking for half of the amount. Elder son says he does'nt have. Two properties belong to father. hence all have 1/3rd Share.One of the property 1/3 rd share is equal to the amount of money borrowed by elder brother for purchasing house in his name.Can mother make a death certificate indicating transfer of 1/3rd share of one of the house in favour of younger son. and other house 1/3rd share equally among the sons.
