Transfer fees in cooperative society in mumbai maharashtra

Narendra K  We are from maharashtra mumbai. Our querry is  Can a cooperative society charge any transfer fees for deletion of first name of the 2 joint holder, on demise of that first member?  Can society charge transfer fees for adding family members names in share certificate to make them joint holders ? Can society charge any transfer fees for transfer of titles in name of blood relatives by way of duly stamped & registered gift deed? 1. **Can a cooperative society charge any transfer fees for deletion of the first name of the 2 joint holders, on the demise of that first member?**
 

 - Generally, cooperative societies cannot charge transfer fees for deleting the name of a deceased joint holder. The transfer of shares to the surviving member is typically considered a routine administrative task and should not attract any transfer fees.

 

 

2. Can society charge transfer fees for adding family members' names in the share certificate to make them joint holders?


   - Adding family members' names to the share certificate to make them joint holders may attract nominal transfer fees. However, if the transfer is within the family, many societies waive these fees or charge a minimal amount. It is advisable to check the specific bylaws of your society.

 

 

3. Can society charge any transfer fees for the transfer of titles in the name of blood relatives by way of a duly stamped & registered gift deed?


   - For transfers within the family, especially through a registered gift deed, societies generally do not charge transfer fees. The Model Bye-laws of cooperative housing societies in Maharashtra state that no transfer premium should be collected for transfers between specified relatives.
