took interview after one year of advertisement

sir an advertisement was published in August 2020 and some candidates have applied for the post. but now our management is going to conduct the interview after one year gap.Is there any legal point that interview can not conduct after one year huge gap or great advertise is required to be published. kindly help

Quick Summary
An advertisement was published in August 2020, and interviews are now being scheduled over a year later. The question is whether there are legal restrictions on conducting interviews after such a significant delay, or if a new advertisement is necessary. Experts advise that there is generally no strict legal timeframe for completing recruitment processes in India, even for government roles where delays of several years can occur due to various factors. The employer's decision typically governs the timeline, and a new advertisement is usually not required unless the original process has been formally closed and rejected candidates are being reconsidered.

No. Sometimes even in State or Central Government also takes more time to conduct interviews. If you have any grievance, you may ask them the reasons, using RTI.

What type of Company is it, Govt. or Private? Nevertheless in India there are instances to recruit people after 5 years passed after conducting of written exam. This happens regularly in Government Organizations and pendency of Court Cases are amongst other reasons.

To the best of my knowledge, there is no law stipulating the time frame for conducting the Employment process like the issue of advertisement, the conduct of written test if any and conducting interviews, etc. Normally, the organizations out of their need finish the process in a certain time frame convenient to them.

I agree with the experts. No time limit to conduct interviews / written tests after the expiry of one year or more from the date of advertisement. Generally, the recruitment process comes to an end when the requisite number of candidates are selected and posted for the number of vacancies advertised. But after the closure of the recruitment process, the company cannot reopen interviews of the rejected candidates under the expired process.

Who is the employer concerned? Please post complete facts.

It is decision of concerned employer, which do not involve any legal dispute for consideration and obligation of experts on this platform.
