The Kerala Shops & Commercial Establishments Rules

Under Rule 10(1)of The Kerala Shops & Commercial Establishments Rules a Register of Employment has to be maintained in Form A.This gives details of over time work of employees.

Under Section 7 of the said Act Extra wages at the rate of twice the ordinary rate of wages have to be given for the over time work..

I understand ,as per Gov, notification IT Software industries in the State are exempted from the compliance of Sec.6,9,10,11 & 20 but not from Sec.7..

My query is that are Software companies in Kerala state paying this overtime wages ??

Is there any other Gov.orders exempting software companies from this ??

Dear Satyam,

There is no government notification exempting any Company from paying Overtime wages

I am not aware, if each and every Software Company pays overtime or not. But as far as i am aware of the functionality of the software Companies, they have a novel method of gving paid compensatory off in lieu of additional overtime wages.
