Tenant not evicting the shop

In 2005 I had rented a shop to a person for jewellary shop.we had made a agreement though a public notary for five year.

In the agreement it was clearly written that he will evacuate the house after 5 year.

but till now after 2 year passed he is not evicting the shop.

he is asking ask to settle the dispute in court,bcoz he know that it takes years and years in judgement.

what should i do?

can i get my shop back?

is the agreement made by us through public notary is legally valid?

on what grounds may I file case such that I come on strong side?

plz help

Except court you don't have other way to evict him.

Yes there is only remedy to file eviction suit.

Notary agreement is not legal and so now he is protected tenant.
