Technical resignation Govt Service - return to parent Deptt.

Im a new memeber of the club. Im looking for following assistance.

I was a central govt. group-a employee for nearly 20 yrs. I applied for a higher post on direct recruitment basis under a Central Auto Body. (CAB) thru proper ch and got selected. while forwding my appln parent deptt mentioned a condition that in the event of selection you vl have to resign and lien vl not be retained .

On my selection I submitted my technical resignation and requested for granting lien also as I was not selected by the CAB on immediate absorption basis and there was a probabtion pd invoved in the new post.

However my technical resign was accepted without retaining lien though this appears to be unlawful as this suddenly rendered my regular service to temporary after joining with the CAB as I vl be on probation even though I had moved from Central Govt to CAB thru proper ch.

My probation at the CAB will be completed in another six months and thus as of now my service is not regularized and Im not absorbed in the CAB. My specific querries are as follows.

1. Whether the concerned Central Govt. deptt. was legally right to accept my technical resign without granting lien for the probabtion pd as requested by me?

2. If at this stage (before getting regularized and abosorbed in the CAB) I want to return to my parent Deptt., what is the legal position in this regard?

I also want reference to specific CCS rules, SR provisions and any selltled law that can help me if I want to return to my parent deptt.
