Summoning witnesses to depose in court or cross examine

Sirs,

Cr PC 311 gives one(victim) power to apply to Court for caling witnesses who may not come on his request.

Can judge deny that he is not obliged to summon on his request?.

Can these witnesses refuse to depose in the court?

If they refuse to depose can lawyer of Victim cross examines them ,ask questions which can prove the case of victim ?

These witnesses are essential for proving the case.Kindly elucidate

You can file application first, it is upto the court to decide.. you have to convince the court how importance that witness in your case.

There being no direct Chashamdeen Gavah ,there are others who are on the side of accused .if called to court ,they can depose or by cross examination it can be proved by inference that accused is to be blamed .
