SUIT IS PENDING MAY I SOLD THE PROPERTY

 

Dear friends

 

 i have another query

 

I filed a suit for declaration of title and suit is decreed in my favour ,  after the decree that on the same scheduled 

land another person  file a suit for perpetual injection and he got injunction order the plaintiff in the second suit

described  myself   and who are the defendant  in the first suit as  defendant  in the suit . 

in this stage my i sold the property which was decreed by the same court at first.

second suit is for perpetual injunction guided by specific relief act, there is no right, title and interest of the same sheduled land is involved in the second suit and in the earlier suit your title had been declared by the learned court.......thus as per sec 52 of the transfer of property act you can transfer the scheduled land.
