Sucession certificate

Dear Expert

agreement for lease was signed by the father and son jointly with 'A' company

Subsequently father expired/died.

Son claiming for rental share of his father be paid to him

What are the documents the company should insist/get from the son to asserain that he is the only leagal heir and to pay the father share of rent to the son? Sucession certifcate is required?

In respect of immovable property there is no need of succession certificate, except some State in India.In respect of movable property if there is no mention of nominee then it is requre to get succession certificate from the Court.

Dear Sir,

   I can not agree totally with Bhadraji, though there is nominee even then if any one file a claim petition or represenatation . Then one should get succession certificate becsue, the basic principal is nominee to receive not to enjoy .
