Status quo order in promotions

Two feeder cadres are prescribed for promotions to the post of Class A from Class B and C, that is 60% and 40% respectively, the direct promotion from Class C to A has been struckdown by Writ Court stating such provision is unconstitutional and contrary to Art. 14 & 16 and promotions be given from feeder Cadre of Class B only.

Writ Appeal has been filed challenging the same, wherein Court granted Status Quo.

Now promotions to Class B under 60% quota which is not struckdown by Court are also stalled by Status Quo Order passed by the Court.

Kindly need solution and judgements rendered by Apex Court in respect of other feeder which was never under challenge.

Facts posted are less than convincing. it is impossible that there could be a situation where a person holding group C post is promoted group A post.

Since the matter has been stayed by high court in the writ appeal, and if you are affected party, you may file a petition to vacate the stay and request the high court to expeditiously dispose the writ appeal.
