Stamp duty if property transfer in family.

Hello Experts,

 Our house is in Nashik was Solely in my father's name, however my father pass away in April 2025. After that as a legal heirs my name, my brother's name, my sister's name, and my mother's name were added to the property. Now all of us siblings want to transfer this entire house in our mother's name so is there any stamp duty applicable for this, if yes then how much will it be applicable since our home valuation as per todays redirecionar rate is 50 Lakh.

The siblings can relinquish their rights and interest in favour of the mother. Stamp duty varies fromm State to State . It is the general case, such gift, settlement or relinqishment among specified relatives only requires nominal stamp duty.

I endorse the opinion and advise of learned senior expert Mr. P Venu.

Relinquishment Deed by all siblings in favour of mother is the best option, however, a Gift Deed may also be considered.

Stamp duty is a State subject which differs from a State to another, however, for RD it is Rs. 100/- stamp duty in Delhi

Under the Maharashtra Stamp Act, a Release Deed executed in favor of a parent, spouse, child, or sibling (lineal ascendants/descendants or siblings) for ancestral or inherited property is subject to a nominal flat fee rather than a percentage of the market value.. The standard stamp duty is Rs. 200/- This nominal rate applies only if the property is residential or agricultural and is inherited.
