Hi Experts,
Tenants are staying in flat since 2008. Landlord mortgaged the flat in 2009 which got NPA in 2010 . Landlord is absconding since 2010. Now the society is asking maintenance from tenants .
Case is already running is many courts.
Is it justify.........?

It is justifiable. Since Apartment owners and tenants have to pay maintenance fee for the amenities and service enjoyed by them in their apartment. Expense incurred for the maintenance of common area is shared among residents of apartment and income is distributed among apartment owners.
