small piece of residencial plot

we are living in a property which was gifted by the government to our grand father 100 years back. There is no documents available now. Our parents nomore. We have decided to identify our shares of land available. We are 3 brothers and 3 sisters, all married. My querry is 1)whether sisters having rights in this property. 2)who will get the 1st portion of land starts from road side whether elder son or any body else.

Dear Mr. Mohan,

Now daugters are also legal heirs entitle to have share in the property so they will have share equal to other legal heirs. Another, there is no law about preferential share in property it will be as per your understanding.

Post the 2005 amendment to Hindu Succession Act, daughters have equal right to inherit ancestral property as that of the son.

You will have to find out status of land from concerned revenue/ municipal records.

It is advisable to consult and engage a local prudent lawyer for appreciaition of facts/ documents, professional advise and proceeding.
