Should i answer YES/NO in DS-160 Visa form

Hi all,

My bhabhi has put 498A/DP3/4 case against the family. 

I have to go to US for higher studies. My classes would begin from Aug 10th 2011.
I have anticipatory bail taken (I went to Women Police Station and did put signatures in some forms), i  wasnt arrested anytime. In DS-160 form (for visa) , there is a question:
Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty, or other similar action?


What should i answer for this question. My lawyer says Anticipatory bail equates Arrest, so i should put YES?

I would prefer not to go for Visa if the answer should be YES.If the answer should be NO, should i seek permission from court for traveling to US.

forgot to add :  My name is present in chargesheet. I visit the court for attendance.

write NO.. get the visa and meanwhile take permission from the court to go out for higher studies.. u will get permission wihtin 2-3 days..
