please help matter was in mediation but due to delay of my appearance judge has passed ex parte divorce order. now i want to know what should be the correct defense. like application to set a side in the same court , or to challenge in the high court and what is the time frame to apply.

u have file application under order 9 rule 13 for setting aside ex-parte decree.. be fast as limitation time is 1 month from your knowledge. u must have show reasonable reason for your non-appearance. be careful while drafting this application as the Supreme court in recent past has given some strict judgements for not setting aside the ex-parte decree in normal course of action.
