service of dismissal order

The management sent dismissal order by regd.post. The postal dept  returned the tapal with the remark"intimation given-not claimed".There was no refusal of tapal.The management contended that the dismissal order is served.whereas the worker contends that the dismissal order is not served.Pl.give some citations that postal remark for returning the tapal with remark "intimation given-not claimed" does not amount to serving the dismissal order.

kindly refer to general rules civil and cpc on service of summons. the postal department has not clarified that the employee had personally refused to receive the copy of the dismissal order,
