Selling flat

Sir,

I am the owner of a piece of land, I have the building permission for ground +3 floors. Now I have built the ground floor and first floor, but due to some financial constraints could not build further. I have been living in the 1st floor for the past 3 years. My dad had an accident so we ran into a huge debt. Now I would like to sell off the second floor. Could someone please tell me how I should proceed with the agreement between me and whomever buys the 2nd floor. The thing to be noted is after he builds the 2nd floor will the 3rd floor be mine? And if so do I have to specify it in the agreement? I would really like some help. Thank you

Permission to build does not imply permission to sell. If you obtained permission for an Apartment complex with undivided shares in the land for all apartment owners (guided by your local building laws), then you can contemplate selling the second floor. AS IS - it is illegal to sell any portion that is still in the air.
