Seeking legal advice on applicability of two acts

Hi am ram, working as Junior manager HR in TVS . Now we are consructing a factory in Maharashtra, as per BOCW ACt, most of the contractor in our premises were registered and doing necessary compliance. In the middele of next month we are planning to start factory in one part of the primises and rest of the parts will be in constrcution. As per BOCW provison , if the provsions of factory act applicable then BOCW would'nt be applicable. But the contractor those who are already registered with BOCW is having validity up to 3st Dec 2010. In this scenario contractor has to follow the BOCW act or factories act. Is ther any provison in our indian penal code like 'unless the expiry of the old act like BOCW certificate , contractor has to follow the old provisons of the BOCW and after the expiry, they need to follow factories act.
