Section 80 CPC: Affidavit Vlidity

Page no : 2

kranthi (retainer advocate)     14 October 2010

Uma garu, one thing is that when any affidavit is filed before the court it should be attested by another advocate as the sign signed in his presence, it will be so easy when an advocate is engaged. In ur case there is no advocate engaged so u have to follow the procedure said by Ramanadan garu

What I know is while filing any suit, It is the work of the court clerk (here they are called as “Siristedar”),or it is court clerk who  do affidavit and verification. Notarized affidavit generally is not acceptable and also verification/ affidavit by Gazetted officers. If I am wrong then plz. Correct me.

At least for guidance hiring good professional lawyer is necessary.

Dear Uma,

Notarised   affidavit is enough to file before any Court, and also in some Courts, the Oath Commissioner will be available,  his attestation is also O.K.  It is not compulsory that an Advocate should attest your signature.

For Section 80 notice no affidavit is required. Draft-Plaint may be sent to the concerned goverment body. After lapse of the stipulated time, the plaint can be filed in court. Affidavit on evidence may be filed at appropriate juncture of the proceedings.
