I think it is not applicable in pending suits before 2005. There is not any clause that the Act would be applied with retrospective effect.

As andwhen the amendment comes to the law or a particular section in the form of insertion of the clause or in addition such as provisio it is always come in effective with the prospective nature unless and untill it is specifically stated.
