Section 5 of  of limitation act is for seeking  condonation for delaying (on reasoned grounds)  any action which was to be fulfilled under prescribed period of time .

S5applies for condonation of delay for appeal purposes only not to file fresh suit .if limitation is proved then suit is barred by limitation .
