Respected Senior Advocates,
I am a Junior Advocate, My Client (ICICI Bank) got attachment on 3 Floors Building, due to default of loan repayment by building owner. CMM Court gave a order infavour of my Client i.e ICICI Bank. One of the Tenent approached Civil court, "I have registered lease deed, my tenure is 5 years, I have tenency rights on property i won't vacate", and approached the Civil court.
According to my argument Civil Court has no Jurisdiction to enter in this matter, after matter decided my CMM Court.
Is there any recent Judgements of Supreme court for favourable to Company.
