SC Ciation Required on CrPC-161 statements contradiction

Hi All,

 

Please help witht he citation for the below situation:

One of the ststement in CrPC-161 statement recorded by police is new and is not supported by the other case witnesses and the complainant. Also this witness heare say witness.

I believe this new statement discovered byt he single witness of the case is considered as contradiction and is not vailed in the eye of law.

I seek citation on this point. Kindly help me.

Hi Sirs,

 

As per CrPC-162 the contradicting statements recorded by the police in their case dairy are considered as omissions in the case.

 

In this scenarion, if only one witness say one allegation which is not told by either complainant and the other witnesses during the police recording their statements U/s 161 of the case is not considered for any purpose of the case, am I correct ?
