Sanctioned accrued / earned leaves not implement 7 years to

 
--  We are working as HIV/AIDS Counselors on Contract Basis in ICTC/ART/STI/Blood Banks at General Hospitals, District Head Quarter Hospitals, Area Hospital, Community Health Centers and Primary Health Centers, all over A.P. more than 1800 employees are working under APSACS. My principal employers are APSACS.Funding Support by Minister of Health Family Welfare, Government of India, through National AIDS Control Organization (NACO) to A.P. State Aids Control Society (APSACS). We are working to prevent the HIV/AIDS by giving awareness to the clients and also giving psychological counseling (Tension, Anxiety, Depression, Suicide, Phobia and Problem Solving counseling for patients with HIV/AIDS). We counselors being seniors having 12 year experience (since 2002) and qualified at Master Degree level in Psychology/MSW/Sociology .

The project is as per National AIDS Control Society guidelines , as per NACO guidelines F.No.T-11011/2/2002/NACO (A) Dt.21.02.2002, issued by R.K.Kalia, Dy.Secretary to the Government of India and T-11020/64/2004 NACO (ART) Dt.20.03.2008 issued by Vijaya Kumar Reehi, under Secretary to the Government of India entitled for (accured/earned) 30 CLs and 10 sick leaves.

i.e..30 days accrued / Earned Leave to the contractual employees (i.e. 2 ½ days per month) if the contract period is more than one year and 10 days sick leave for 1 year irrespective of the rank held by them
 


 but Andhra Pradesh State AIDS Control Society had given only 12 CLs per year from 2002 to Feb 2009, after Feb 2009 implementing NACO guidelines. here our tights exploited ,Counselors are asking for compensation of lost leaves.
 
as per order accured/earned leaves not implemented 7 years


if any chance we get compensation for accured/earned leaves which  labor act? pls suggestion act rules /procedure/case

if any employee working same and similar and same kind of work which is done by the regular worker of the establishment then the working condition/service condiction shall be same.

secondly the notification guidelines clrealy speak that a contractual employee shall be entitled to 30 days acrude/earned leaves and 10 days sick leave

as a basic principle and alson envesiged in various statutes like Factoirs Act/Shop Acts/Even central govt service rules earned leave if not availed by employee than shall be enchased, subject to total accumulation in your account at the time of leave of services bye whatever means.

more than the leave priscribed for accumulation automatically lasped.

but there is no provision which provide enchasment of unavailed leaves which during the service.may i am not aware any other memeber may through some light.

APSACS is Principal employer.  who is immediate employer.
