- Pre–Dec 1990: Property (plot with old house, 4000 sq. ft.) allotted to Mr. X (minor); khata mutated in his name. His father Mr. Y acted as guardian.
- Dec 1990: Joint development arrangement entered into with a construction company.
- Apr 1991: Plan approval obtained for construction.
- 1991–92: Seven flats constructed.
- Feb 1993: Sale executed by Mr. Z (acting under GPA, details not available) in favour of Mr. A & Mrs. B for one ground floor flat.
- Apr 1995: Declaration executed by Mrs. B through Mr. C (acting under GPA, details not available).
- Jun 2002: Death of Mr. Y.
- Dec 2010: Death of Mrs. B; khata mutated in the name of Mr. A.
- Sep 2025: Mr. A has offered the ground floor flat for sale, which I intend to purchase.
Both GPA are not available with seller.
Is the title said to be defective and original land owner claim flat or undivided share?
Even if the Saledeed void from beginning., since it's more than 12 years ., as limitation Act 1963 ., his right extiguished . After present owner proves that he is peaceful possession of the property all these years?
Really appreciate your advice if I should buy or not this flat.
