Salary pending

WAS WORKING FOR A COMPANY FOR 4 MONTHS WITHOUT ANY OFFER LETTER EXPLOITED BY COMPANY BY MAKING ME WORK LONG HOURS IN PROBATION.AND AFTER I RAISED A VOICE AGAINST IT TO SAVE MYSELF BY TELLING NO TO THE WORK WHICH WAS NOT ASSIGNED TO ME IN MY PROFILE.I WAS TOLD BY HR DEPARTMENT OF COMAPNY NOT TO COME TO OFFICE ON 1ST JULY ONWARDS AND TILL NOW HAD NOT GOT MY SALARY WHEREAS I HAD GOT MAIL REGARDING FNF SALARY SLIP FOR JUNE SO WHAT SHOULD TELL THEM TO GET MY SALARY FOR THAT MONTH?

Demand payment of FNF amount in writing under acknowledgment, by bank DD so as to reach by redg. psot say in next 7 days.

If it is not paid approach o/o Labor Commissioner, or a lawyer.Your lawyer may prefer to issue a legal notice.

Thanks for the advice but in legal battle it will take a lot time as i am not in condition for a legal battle as it would be expensive in my case i cant afford a lawyer.

Can you explain what labour commissioner would help me

You may log on to Dept. of Labor website of your state and read the process carefully.

You shall find all applicable acts at website.

Or you may meet ALC and understand the process being followed at your location in your state. Raise demand Notice. Conciliation officer shall issue notice to company. In some states 3 opportunities in a month are granted. If conciliation process fails matter is referred to labor court. Matter may get resolve during conciliation as wages are not paid.

If you do not send a lawyer in Proceedings Company may also not be allowed to bring a lawyer and shall have to send some employee of the company.

You can also approach some trade union leader and they may help you. The leaders are seasoned, experienced and some good and nice leader may accompany you to company office and help you to get your wages.

Your experienced well wishers, near and dear ones can also guide, support and help you.

A lawyer known to your family or in the neighborhood can also coach, guide, and help you.

If your wages are up to Rs.16000/pm you may approach Wages Inspector.

You can also lodge complaint with Inspector under SE act applicable to your state.
